You might have heard of the term ‘Probate’. This is the name given to the process of collecting in and distributing out, all assets owned by the deceased.
Before the estate can be distributed, as per the directions left in a Will or following the law if there is no Will, a Grant of Probate or Letters of Administration must be obtained.
Sometimes Probate isn’t needed if the value of the estate is small or everything is in joint names.
When Probate is needed, we can help you apply for it and guide you through the process.
Whilst Probate is the legal process, Estate Administration is carrying out all the tasks needed to manage the Estate after someone dies.
This might be gathering information about pensions, paying debts or taxes and then sharing out what is left to relatives or as determined in the Will (if there was one).
To complete some tasks, you must have the Grant of Probate or Letters of Administration.

An example of this would be for someone who has guardianship over children and needs to be able to access funds for their day to day living.

How do I know if I need to apply for Probate?
Each situation is different so we would need to find out more to advise you on this. However, some examples of when you might need to apply for probate are when there are assets such as land or property in a sole name, cash over a certain value or investments.
How much does probate cost?
This will depend on the value and complexity of the estate and whether or not you apply for this yourself or are using a specialist such as Morrell Will Services. We can advise you further when we find out more from you. As a guide, there is a government charge of £300 for estates over £5000. This may increase depending on your requirements, and if you are on certain benefits you may be entitled to financial support.
